Liability Exclusion
Participants take part in our event at their own risk. They bear sole civil and criminal liability for all damages caused by them or the vehicle used by them, unless a liability exclusion is agreed upon. By submitting the registration, participants waive all claims of any kind for damages arising in connection with the events, against the organizer, the track marshals, medical personnel, the racetrack owners, sponsors, race services, and other individuals associated with the organization of the event, as well as the vicarious agents of all previously mentioned persons and entities, except for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty - including that of a legal representative or a vicarious agent of the exempted group - and except for other damages that result from intentional or grossly negligent breach of duty - including that of a legal representative or a vicarious agent of the exempted group; against the other participants (riders, passengers), their helpers, and the owners or holders of the other vehicles, they waive all claims of any kind for damages arising in connection with the training or competitions (timed practice, scoring runs), except for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty - including that of a legal representative or a vicarious agent of the exempted group - and except for other damages that result from intentional or grossly negligent breach of duty – including that of a legal representative or a vicarious agent of the exempted group.
The liability exclusion becomes effective upon submission of the registration for all parties involved, particularly towards ART MOTOR and other co-organizers active in the event and their respective vicarious agents. It applies to claims of any legal ground, particularly both for compensation claims from contractual as well as non-contractual liability and also for claims from unlawful acts. Implicit liability exclusions remain unaffected by the above liability exclusion clause.
The participant is solely liable to the organizer for ensuring that only they themselves drive the vehicle they have registered. Should unregistered riders use this vehicle on the event track, the participant is liable for any damages caused by them in full. Furthermore, a fine of 500.00 EUR will be imposed on the participant whose vehicle was used. The fine is due immediately.
For any damage, loss, or destruction of the transponder, the participant is liable. In the event of damage, the actual incurred costs for repair or replacement, currently approximately 700.00 EUR, will be charged.
