Terms and Conditions

1. Validity

The following terms and conditions apply to the organization of motorcycle events, driving safety, cornering, sports driving, racing trainings, and racing events organized by PR Event GmbH, Reußkamp 32, 23560 Lübeck, appearing in relation to events as Art Motor.

PR Event GmbH, as the owner of the name, is entitled to use the name, logo, as well as all related names and content of Art Motor.

PR Event GmbH and Art Motor are hereinafter referred to as "the organizer", and participating riders who have submitted and completed a registration ("booking") are referred to as "participants". A registration ("booking") is deemed completed when the registration (booking) fee has been paid in full and its receipt has been confirmed by the organizer.

2. Conclusion and Content of the Contract, Withdrawal of the Organizer

The contract is valid with written confirmation from the organizer towards the participant.

The content of the contract and the corresponding services arise from the service description of the offer for the specified duration, as well as from the registration confirmation/invoice. No other form of contract specification is valid, except in the case of a written agreement from both parties.

In the event of force majeure, failure to reach a minimum number of participants, cancellation by the track operator, or other reasons of reasonable validity, the organizer reserves the right to withdraw from the existing contract or to adjust its service offering to the requirements. The organizer will inform the participant accordingly and without delay. In this case, the paid registration fee will be refunded to the participant minus a processing fee of €25.00/day, or the organizer will make an offer for withdrawal with full refund. Cancellations related to pandemics such as Covid-19 are not included; affected individuals who have fully paid their registration fee will be offered a credit (see 4.2). No further claims can be made against the organizer, except in cases of negligence or gross negligence on the part of the organizer or its representatives. The organizer is not responsible for loss of driving time due to related incidents, aggravating circumstances, damage to the vehicle, or bad weather conditions. In such cases, the participant is not entitled to a refund or reduction of the registration fee.

3. Payment Methods and Deadlines

3.1 Payment Terms

The participation fee and all additional services selected during the booking are payable in full immediately upon conclusion of the booking contract. The total price listed at the time of booking applies.

3.2 Payment Methods

Payment processing is carried out exclusively through the payment service provider Stripe. The participant has access to the payment methods offered during the booking process.

The available payment methods will be displayed during the booking process. Payment via traditional bank transfer, check, or cash is not provided.

The organizer does not charge any additional payment fees for the use of the offered payment methods.

3.3 Booking Confirmation and Payment Receipt

After completing the booking, the participant will receive a booking confirmation. The booked participation slot is only definitively secured after successful confirmation of the full payment.

A failed, aborted, or incomplete payment does not lead to the definitive securing of the participation slot.

If a binding booking contract comes into existence, the agreed payment obligation remains in effect even in the case of a failed payment. The organizer may request the participant to make payment again and, if payment is absent after setting a reasonable grace period within the legal framework, withdraw from the contract and assign the participation slot to another party.

3.4 Invoicing

After successful booking, the participant receives a registration confirmation that also serves as an invoice, provided it contains the legally required invoicing details.

The VAT treatment is carried out according to the respective applicable legal regulations.

3.5 Refunds

Any refunds will generally be made using the originally used payment method. If this is technically not possible, the refund may be made through another suitable payment method.

Cancellation and refund claims are subject to the corresponding regulations of these terms and conditions. Legal refund claims remain unaffected.

4. Registration, Deadline, Cancellation and Withdrawal (Cancellation Terms, Registration Fee Refund)

The activation of the registration constitutes a binding registration and creates an obligation to pay the due fee. Withdrawal of the registration or non-payment does not exempt one from this payment obligation.

The registration deadline is 2 weeks before the first event day of the respective event. In the case of later registration, the participation price increases.

Participants have the right to cancel their registration. The cancellation of participation must be communicated to the organizer via email (info@artmotor.de). The right to a refund depends on the timing of the cancellation.

The event begins with the opening of registration on the day before the customer's first riding day on the track.

Participants have the right to name a substitute driver for their entry. The transfer of parts of the entry, including individual days or individual sessions, is not permitted for security and event quality reasons.

A further transfer of the starting place by the subsequent participant is no longer possible thereafter. Insurance benefits are not transferable.

Anyone who transfers their entry or parts of their entry without notification and formal consent from the organizer acts with gross negligence and will be excluded from the event.

The naming of a substitute driver becomes effective only when the processing fee of €25.00 and the difference between the paid entry fee and the price valid at the time of naming the substitute driver are paid within no more than 48 hours after naming the substitute driver.

If this payment is not made within the aforementioned period, the place will be canceled, and the cancellation conditions listed in Section 4 will apply.

5. Disclaimer

The participant takes part in the event at their own risk.

The participant bears civil and criminal responsibility for any damage caused by them or their vehicle, unless otherwise stated in the terms and conditions.

The participant agrees to waive any claims for damages against the organizer, the racetrack operator, the track marshals, medical staff, sponsors, or any other representatives or assistants of the aforementioned.

This disclaimer does not apply to damages resulting from injuries to life, body, or health that are based on a negligent breach of duty by the organizer or on an intentional or negligent breach of duty by a legal representative or agent of the organizer. It also does not apply to other damages resulting from a grossly negligent breach of duty by the organizer or an intentional or grossly negligent breach of duty by a legal representative or agent of the organizer.

The participant waives any claims against other participants or their vehicles, owners, or drivers of other vehicles in connection with the training or the competition. This disclaimer does not apply in situations caused by negligent or grossly negligent behavior of the aforementioned persons that result in injuries to life and limb.

The participant is liable to the organizer for their vehicle as well as for any other person who uses their vehicle in connection with the event. They are obliged to ensure sufficient insurance coverage for this.

6. Protective Clothing

In addition to the mandatory protective clothing for racetracks (undamaged full-face helmet, one-piece or two-piece leather suit with solid connection between pants and jacket, leather boots, and leather gloves), participants are required to wear a back protector, unless it is part of the worn suit (textile suits may also be allowed depending on the racetrack). If a participant wears clothing that is not suitable or approved for the racetrack, the organizer reserves the right to exclude the participant from the event without any claim for refund or reduction of the entry fee.

7. Technical Requirements

The vehicle must be in perfect technical condition. Mirrors, license plate holders, and other protruding parts must be removed by the participant before the event begins (depending on the racetrack). Sharp edges are not permitted and must be removed or mitigated accordingly. Front, rear, and brake lights must either be removed or fully taped and secured (this may not be possible depending on the design). The noise produced by the vehicle must not exceed the limit set by the racetrack operator. The starting number assigned by the organizer (depending on the racetrack) must be clearly visible on the front of the vehicle.

For multi-day racing events, the oil drain plug must also be secured with a wire, and the vehicle’s cooling system must be filled exclusively with water.

Failure to comply with the technical regulations specified by the organizer or racetrack operator reserves the right for the organizer to exclude the respective vehicles and/or participants from the event without the right to a refund or reduction of the entry fee.

8. Behavior During the Event

The participant agrees to follow the instructions of the organizer as well as those of the racetrack operator and the persons authorized by them. The participant also agrees to attend driver meetings. Non-attendance may result in exclusion from the event without any claim for a refund or reduction of the entry fee. The organizer assumes no responsibility for the condition of the racetrack and related facilities.

Throughout the event, the participant commits to behaving in a manner that does not endanger themselves or other participants. Walking speed is the only permissible speed in the paddock and pit lane.

It is prohibited to stop on the track for any reason.

It is possible that differently fast riders use the track during a session, thus special caution and mutual respect on the racetrack is of utmost importance.

The consumption of alcohol is strictly prohibited during the operational hours of the event. Riders will be excluded from the entire event if a situation arises where they are impaired in their ability to ride due to alcohol, other drugs, or medications. To ensure safety during the event, these instructions must be followed under all circumstances. In case of a violation, the organizer reserves the right to exclude the respective participant from the event without the right to a refund or reduction of the entry fee.

9. Transponder

Each participant's vehicle must be equipped with a transponder (depending on the racetrack, also RFID transponders). For safety reasons, riders whose vehicle is not equipped with a transponder will be excluded from the event. The registration of lap times serves only to verify proper group assignments and not for competitive comparison. Non-publication must be explicitly requested by the respective participant at registration. In trophy and championship events with racing operations, the times of all participants will be published. Non-publication must be explicitly requested by the respective participant at registration. The handover of the transponders occurs against a deposit. If the transponder is damaged or lost during use, the participant will be charged for the costs incurred (currently approximately €700.00 gross for loss). If the transponder is accidentally taken home, €10.00 per day will be charged until the day of return by the organizer.

10. Photography and Publication of Lap Times

By agreeing to these terms and conditions, participants consent to the publication of any photos and videos taken during the event for the organizer, participants, or their teams in accordance with §22 KunstUrhG.

Commercial activities by a participant or any of the above-mentioned parties are not permitted without the express written consent of the organizer. In case of a violation, the organizer reserves the right to exclude the participant or the relevant party from the event without further notice or prior warning. In such cases, there is no entitlement to a reduction or refund of the paid entry fee.

11. Data Protection

During the start, execution, and any communication between the participant and the organizer, data will be stored and processed in accordance with legal provisions by the organizer. By participating, the participant agrees to these conditions.

The organiser hereby assures that participant data will not be passed on to third parties, unless legally obligated to do so or authorised by the participant. The organiser will also comply with the data protection law should they use services from third parties. Any confidential information that the participant provides during the registration process or via email (name, contact details, etc.) will be used solely by the organiser or for the purposes for which the information was made available.

The organiser assures that data will only be passed on to delivery services if this is necessary for delivery to the participant. For processing payment transactions, the relevant data will be shared solely with the bank responsible for processing them. Personal details entered on the organiser's website will only be stored until the purpose of that input has been met. Taking tax and commercial laws into account, this may lead to a storage duration of up to 10 years.

If the participant has objections regarding the security of their data, or if this has changed accordingly, the organiser will have the means to delete, correct, or block the data in accordance with the legal framework. As far as possible, this will also be initiated for data shared with third parties. If desired, the participant can request their stored data from the organiser free of charge.
